Terms and Conditions

  • These are the Terms and Conditions between:

    1. The Provider (Agilysis Ltd)

    and

    2. The Customer (Organisation or individual commissioning CrashMap Pro)


    Please read these terms and conditions carefully before using CrashMap Pro which is accessible using the annual ESRI license assigned to the customer and purchased with CrashMap Pro. The username and password for the license will be provided on delivery of the product. 

    By accessing and using CrashMap Pro you agree to be bound by these terms and conditions. If you disagree with any part of the terms or conditions, then you may not use the product. 


    1 DEFINED TERMS

    [CrashMap]
    The CrashMap website www.crashmap.co.uk including the interactive map and databases that are used to display crashes and produce reports.

    [CrashMap Pro]
    An enhanced version of CrashMap delivered using the Esri ArcGIS Online platform, managed and maintained by Agilysis.

    [CrashMap Reports]
    Individual reports generated by users of CrashMap and CrashMap Pro downloaded via a reporting tool built-in to the CrashMap website.  Each downloaded report consumes one CrashMap Credit.  Reports remain permanently available to registered users following purchase.

    [CrashMap Credits]
    Credits can be purchased in varying quantities by users of CrashMap through the website and are exchanged for the production and download of individual CrashMap Reports. CrashMap Pro users receive 500 credits per account per year, unused credits are not rolled-over. Any CrashMap Pro user who requires extra credits can purchase these for the associated CrashMap User Account via the CrashMap website.

    [CrashMap User Account]
    An account setup by CrashMap users who wish to purchase credits and download reports. A user account is not required for casual viewers of the map. Each CrashMap Pro License has an associated CrashMap User Account which is allocated CrashMap Credits.

    [CrashMap Pro License]
    A CrashMap Pro License entitles the nominated user to access CrashMap Pro for the agreed license period (one year unless otherwise specified).

    2 CRASHMAP TERMS OF USE
    1. The content of the pages of this website is for your general information and use only. It is subject to change without notice.
    2. This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
    3. The underlying data is provided by the Department for Transport under the Open Government License - http://www.nationalarchives.gov.uk/doc/open-government-licence/version/3/
    4. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
    5. Crashes shown on the map and in reports are subject to change including removal at any time.  This is subject to decisions made by the Department for Transport when the data is published or updated and we do not make amendments or edits to the data.
    6. The use and protection of your information when using the website is covered by the privacy policy   which is accessible here: crashmap.co.uk/home/privacypolicy
    7. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.
    8. All trademarks reproduced in this website which are not the property of, or licensed to, the operator are acknowledged on the website.
    9. Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.
    10. We will store your information securely, never share it with any other companies or agencies, and never use it for any other purpose.
    11. From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
    12. Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Northern Ireland, Scotland and Wales.
    13. Credits and reports purchased are non-transferable and non-refundable.
    14. Reports and data retrieved through CrashMap may be used and reproduced as part of your own work, including where this work is for sales or reward.
    15. Any such reproduction should reference “CrashMap, www.crashmap.co.uk”.  The data source should be acknowledged as “Department for Transport data published by www.crashmap.co.uk”.  Maps should also include ‘Map Data Copyright Google [Year]” if this credit is removed by the user.

    Esri Partner Network Solution Delivery Terms and Conditions

    Flow-Down Terms and Conditions for Hosted Solutions. Partner shall flow down the following terms and conditions through terms of use that must be expressly accepted by a Solution Delivery End User through a click-through mechanism, website acknowledgment, or signed license agreement. Partner's agreement shall also include any additional terms of use and use restrictions in the Master Agreement that may be applicable to Authorized Sublicense Material in Hosted Solution as authorized in this Attachment A and described in the Sales Authorization application and approved by Esri:

    1. Disclaim, to the extent permitted by applicable law, Esri, its licensors and Distributor's liability for any damages or loss of any kind, whether direct, special, indirect, incidental, or consequential, arising from the use of the Hosted Solutions including, but not limited to, liability for use of Hosted Solutions in high-risk activities or liability related to any Data supplied by Esri for Distributor.
    2. Require Solution Delivery End User at the time of termination of the Esri Partner Network Agreement or this Attachment A or use of Hosted Solutions to (i) cease access and use of the terminated Authorized Sublicense Material in Hosted Solutions, and (ii) clear any client-side data cache derived from the terminated Authorized Sublicense Material in Hosted Solutions.
    3. Require all Solution Delivery End Users to comply fully with all relevant export laws and regulations of the United States, including, but not limited to, the Export Administration Regulations (EAR), including prohibited end users and end uses as referenced in Part 44 and Supplement No. 4 to Part 44 of the EAR (https://www.bis.doc.gov/index.php/documents/regulations-docs/2343-part-744-control-policyend-user-and-end-use-based-2/file and https://www.bis.doc.gov/index.php/documents/regulationsdocs/2347-744-supp-4-6/file); International Traffic in Arms Regulations (ITAR); and the United States Department of Treasury, Office of Foreign Assets Control (OFAC) regulations, and to ensure that Esri products, or any direct product thereof, are not exported, reexported, transferred, diverted, used, or accessed, directly or indirectly, in violation of any United States export laws and regulations. When applicable, Partner and any Solution Delivery End Users will provide Esri with information about Partner and Solution Delivery End Users' export and distribution activities as may be required for Esri to meet its obligations under the United States export control laws and regulations.
    4. Prohibit the removal or obscuring of any patent, copyright, trademark, proprietary rights notices, or legends contained in or affixed to any Authorized Sublicense Material, output, metadata file, or online or hard-copy attribution page of any Data with respect to Authorized Sublicense Material.
    5. Disclaim all terms in the Esri Click-Through Master Agreement (E204CW) included with Authorized Sublicense Material. Esri and its licensors do not warrant that Data and Authorized Sublicense Material will meet the Solution Delivery End User's needs or expectations; that the use of Data, Authorized Sublicense Materials, and Hosted Solutions will be uninterrupted; or that all nonconformities can or will be corrected. Esri and its licensors are not inviting reliance on Data in Authorized Sublicense Materials, and Solution Delivery End User should always verify actual Data in Authorized Sublicense Materials. Any warranty offered by Partner for the Partner Hosted Solutions shall only apply between Partner and its Solution Delivery End Users. Esri does not offer any warranties or indemnities to Solution Delivery End User for the Authorized Sublicense Material.
    6. Prohibit Solution Delivery End Users from using Authorized Sublicense Material for any revenuegenerating activities. Authorized Sublicense Material in Hosted Solution is for the internal use of Solution Delivery End Users only.
    7. Prohibit Solution Delivery End Users from using Authorized Sublicense Material independently from Hosted Solution or in any other product or service.
    8. Prohibit Solution Delivery End User from storing, caching, using, uploading, distributing, or sublicensing content or otherwise using Authorized Sublicense Material in violation of Esri's or a third party's rights, including intellectual property rights, privacy rights, nondiscrimination laws, export laws, or any other applicable law or regulation.
    9. Prohibit sharing of Named User login credentials. These are for designated Solution Delivery End Users only and may not be shared with other individuals. A license may be reassigned to another Solution Delivery End User if the former user no longer requires access to the Hosted Solution.
     
    3 CRASHMAP PRO TERMS OF USE
    1. These terms are in addition to those in Section 2 for CrashMap
    2. Each CrashMap Pro License is provided to a named user as required by Esri under our Terms as an approved Partner.  Usernames and passwords may not be shared and any breach of this condition may lead to your account being suspended.
    3. Data downloaded including reports, maps and diagrams remain available for use by you following any expiry of the license period
    4. The use of any Microsoft Excel templates or user guides provided by us is at your risk and you have the responsibility to ensure accuracy before publishing and analysis based on these tools.
