Terms and Conditions

• These are the Terms and Conditions between:
  
  1. The Provider (Agilysis Ltd)
  
  and
  
  2. The Customer (Public sector organisation commissioning the site selection tool for their local area)

   

   

  A Site Selection Tool License entitles the nominated user to access the Site Selection Tool for the agreed license period (one year unless otherwise specified).

   

  1. The content of the Site Selection Tool is for your general information and use only. It is subject to change without notice.
  2. Users may not assign any use of the account whatsoever to any other party, whether or not connected to the organisation, on any basis whether permanent or temporary, and does not disclose or permit to be disclosed to any party, even through failure to take reasonable security precautions, any account details such as login passwords supplied by the Site Selection Tool Provider.
  3. Data, maps, and images derived from this application may not be resold in any form, either in whole or in part, except by express prior written consent of Agilysis. Data, maps, and images derived from this application may be published by the licensee, on strict condition that the source is acknowledged as Site Selection Tool by Agilysis, along with a link to Agilysis’ website (agilysis.co.uk).
  4. Any person who supplies personal information to Agilysis for the purpose of setting up a user account understands and accepts that this information may be stored by Agilysis and used for purposes related to maintenance, supply, and upgrade of this and similar applications. Agilysis will never supply such user contact information to any third party.
  5. This application contains material which is owned by us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
  6. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this application for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
  7. Your use of any information or materials in this tool is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this application meet your specific requirements.
  8. All trademarks reproduced in this application which are not the property of, or licensed to, the operator are acknowledged on the application.
  9. Unauthorised use of this application may give rise to a claim for damages and/or be a criminal offence.
  10. From time to time this application may also include links to other tools. These links are provided for your convenience to provide further information. They do not signify that we endorse the tool(s). We have no responsibility for the content of the linked tool(s).
  11. Your use of this application and any dispute arising out of such use of the application is subject to the laws of England, Northern Ireland, Scotland and Wales.
